Though his parents are facing immigration issues, he was born in the U.S. and has been considered a U.S. citizen. English is not his primary language, but he does speak English, and two additional languages associated with South America. He is one of five siblings, but has not seen his other siblings since being placed in a foster care environment. He exhibits reasonably good behavioral characteristics, but has shown struggles with basic skills in reading and math. At issue is whether he meets the criteria for receiving special education services, and if so, to what extent.”
